ATA Appealing California Port Plan

On October 8, the American Trucking Associations set an appeal in motion with the U.S. Court of Appeals, standing firm in its efforts to fight off the enforcement of concession plans that went into effect with the Clean Truck Program in California on October 1.

The ATA says the port plans for Los Angeles and Long Beach are unlawful and change the regulation of the port trucking industry in a way that impacts shippers, motor carriers, businesses and consumers that rely on the merchandise handled at those ports.

In its recently filed opening brief, the ATA contested that most of the requirements for the concession plans have nothing do with safety, claiming the ones that do are merely repeating federal and state legislation. Additionally, the ATA explained that it supports the replacement of older trucks with CTP, yet doesn’t agree with the port’s concession plans. The ATA announced that the court could issue a final decision by as early as next month.
